ARC WIRELESS COMMUNICATIONS SOLUTIONS DIVISION LIMITED ONE YEAR PRODUCT WARRANTY

The Company warrants that all of its Product(s) shall be free from defects in workmanship and materials for a period of one year from the shipment date to the customer. With respect to any Product which is defective, it shall be returned to the Company's designated location, freight prepaid, and upon receipt by the Company, the Company shall either (a) replace the defective Product with non-defective Product, or (b) remit a check to the customer equal to the amount of the customer's price to the Company for the Product.

NO WARRANTIES, EXPRESSED OR IMPLIED, OTHER THAN THE ABOVE-STATED WARRANTY, ARE GIVEN IN RESPECT TO THE COMPANY'S PRODUCTS, AND ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PURPOSE IS HEREBY EXPRESSLY DISCLAIMED. ANY ACTION FOR ANY ALLEGED BREACH OF THE ABOVE-STATED WARRANTY IN RESPECT OF THE PRODUCT MUST BE COMMENCED WITHIN ONE YEAR AFTER THE CAUSE OF ACTION ACCRUES, AND IF NOT COMMENCED WITHIN THAT PERIOD, THE RIGHT TO BRING CAUSE OF ACTION SHALL BE DEEMED TO HAVE BEEN WAIVED.

IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY LOSS OF ANTICIPATED PROFITS, OR FOR THE LOSS OF USE, OR FOR THE COST OF "COVER" OR FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES. BUYER WAIVES ANY RIGHT, EXTENDING BEYOND THE FOREGOING WARRANTY TO CLAIM FOR NEGLIGENCE IN DESIGN, MATERIAL, WORKMANSHIP OR INSTALLATION.

RETURNS

In the event a customer discovers a product to be defective, the customer reserves the right to submit a Return Merchandise Authorization (RMA) under the following procedure:

·          Return product on customer's shipping account with RMA number clearly noted on package. If antenna arrives damaged, The Company will not be responsible to repair, replace or return it.  

·          The Company will test the product for issues noted in the RMA.  If the product is out of specifications or malfunctioning due to manufacturer defect, The Company will either repair or replace the product and return it to the customer on The Company's shipping account via ground service.  

·          If the failure is associated with a manufacturing defect then we will provide the customer a credit on their next order in order to refund shipping costs associated with returning the product. 

·          If the antenna is not defective the customer will be charged a testing fee of $10 per antenna with a $50 minimum per batch.   The product will be returned to the customer on the customer's shipping account number.
